SEC Brings First Enforcement Action for Violation of the Identity Theft Red Flags Rule

On September 26, 2018, the SEC brought its first ever enforcement action for violations of Regulation S-ID (the “Identity Theft Red Flags Rule”), 17 C.F.R. § 248.201, in addition to violations of Regulation S-P, 17 C.F.R. 30(a) (the “Safeguards Rule”). Regulation S-ID and Regulation S-P apply to SEC-registered broker-dealers, investment companies, and investment advisers, and require those entities to maintain written policies and procedures to detect, prevent and mitigate identity theft, and to safeguard customer records and information, respectively. Alston & Bird Issues Cyber Alert on the EU Network Information Security Directive

This morning, Alston & Bird partners Jim Harvey and Jan Dhont issued an Advisory on the EU’s forthcoming Network Information Security Directive (“NIS Directive”).  National laws passed to implement the NIS Directive will impose substantial new compliance responsibilities on providers of “essential services,” as well as on a broad range of “digital service providers”—potentially even if a digital service provider’s only EU presence is a website.  Companies subject to the NIS Directive will be obligated to implement internal cybersecurity measures.  Moreover, the NIS Directive […] Read more

Kim Peretti was a featured speaker at Georgetown Law’s 2016 Women’s Forum, titled “Opportunities in a Changing World,” held on March 4. This annual program features dynamic speakers on several interactive panels.
